By visiting penssistant.com or purchasing, receiving, or using any Penssistant product, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the site or purchase our products.

1. Overview

Penssitant ("we," "us," "our") operates penssistant.com and sells smart pen capable of various things. These Terms apply to all visitors, customers, and users of our site and products. We may add new features or update these Terms at any time; continued use of the Services after changes means you accept the revised Terms.

2. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) to purchase from us. By purchasing, you confirm you meet this requirement and that the information you provide at checkout is accurate.

We try to keep product details, pricing, and availability accurate, but errors and omissions can occur. If something looks wrong or unclear, contact us at support email before relying on it.

5. Products, Availability & Returns

Some products may be available only online and in limited quantities. We may limit sales by region, jurisdiction, or quantity, and may discontinue products at our discretion. Returns, exchanges, and refunds — including issues with lost or damaged shipments — are governed by our Return & Refund Policy.

6. Sold "As Is" — No Warranty

Our products and Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or reliability. We do not guarantee the product or Services will meet your expectations or operate uninterrupted or error-free.

7. International Orders, Customs & Taxes

If you order from outside Georgia, your order may be subject to import duties, customs fees, and local taxes. These charges are not included in our prices or shipping fees and are entirely your responsibility. It's your responsibility to check your local customs and import regulations before ordering — we are not responsible for delays, extra charges, or seizures once an order has shipped.

8. Modification, Disassembly & Reverse Engineering

Opening, disassembling, modifying, or reverse-engineering the product (hardware, software, or firmware) in any way is prohibited and is done entirely at your own risk. Doing so immediately voids any warranty, return/refund eligibility, and our support obligations.

9. Intellectual Property

All content, branding, designs, software, and firmware associated with our products remain the sole property of Penssistant or its licensors. Purchasing a product grants you a non-exclusive, non-transferable license to use it for personal, lawful purposes only.

10. Feedback

If you send us suggestions, ideas, or feedback, you agree we may use them freely, for any purpose, without notice, attribution, or compensation to you.

11. Third-Party Services & AI Disclaimer

Our products/Services rely on third-party providers, including AI services (e.g., OpenAI, Anthropic). We are not responsible for the accuracy, availability, or reliability of these third-party services, including any AI-generated output, which may be inaccurate or incomplete. Verify important information independently before relying on it. By using our Services, you accept the use of these third-party providers.

12. Limitation of Liability

To the maximum extent permitted by law, Penssistant is not liable for any indirect, incidental, or consequential damages arising from your use of our products or Services. Our total liability for any claim is limited to the amount you actually paid for the product, excluding attorneys' fees and related costs.

13. Indemnification

You agree to indemnify and hold Penssitant harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or violation of any law or third-party right.

14. Governing Law

These Terms are governed by the laws of Georgia. Our Services and products are sold internationally; if your use of them violates the laws of your local jurisdiction, such use is not authorized and is at your own risk — we make no guarantee of compliance with laws outside our operating coutnry.

15. Prohibited Use

You may not use our Services or products for any unlawful purpose, to infringe intellectual property rights, to resell or redistribute without permission, or in any way that violates these Terms. Violations may result in suspended support and loss of any remaining warranty or refund rights.
